Report suspected wrongdoing
Anyone with an interest in the activities of Fondazione Erice Arte may submit a written or electronic, non-anonymous report of an actual or suspected breach to the Supervisory Body. The Supervisory Body reviews the report and may hear both the reporting person and the person alleged to be responsible.
The Supervisory Body must protect reporting persons against retaliation, discrimination or any other disadvantage. Their identity will be kept confidential, subject to any disclosure required by law.
By submitting a report, you acknowledge the Privacy Policy and consent to the processing required to manage the report. Email: odv@fondazioneericearte.org.
Transparency and civic access
Italian law provides several forms of access to public-sector documents and information. They differ according to the applicant’s entitlement and the degree of transparency involved.
- Access to administrative documents under Article 22 of Law no. 241/1990, as amended, is available to anyone with a direct, specific and current interest connected with a legally protected situation and the requested document.
- Simple civic access is governed by Article 5(1) of Legislative Decree no. 33/2013, as amended by Article 6 of Legislative Decree no. 97/2016.
- Generalised civic access is governed by Article 5(2) of Legislative Decree no. 33/2013, as amended by Article 6 of Legislative Decree no. 97/2016.
Simple civic access
Simple civic access allows anyone to request documents, information or data that are subject to mandatory publication where the competent organisation has failed to publish them. The request is free of charge and does not need to state reasons.
Submit the request to the Fondazione Erice Arte Supervisory Body by post at Piazza della Loggia 3, 91016 Erice (TP), Italy, or by email to odv@fondazioneericearte.org.
After confirming that the request is well founded, the Supervisory Body forwards it to the records office holding the information. That office arranges publication within 30 days and sends the information to the applicant, or confirms publication and provides the relevant link. Protection of the right of civic access is governed by Legislative Decree no. 104 of 2 July 2010.
Generalised civic access
Generalised civic access allows anyone to request documents, information or data held by public administrations in addition to material subject to mandatory publication, within the limits protecting legally relevant public and private interests under Article 5-bis of Legislative Decree no. 33/2013.
The request is free of charge and does not need to state reasons, but it must identify the requested documents or records clearly and precisely. Generic requests are not accepted, and the administration is not required to create information it does not already hold.
Submit the request to the competent office at Fondazione Erice Arte, Piazza della Loggia 3, 91016 Erice (TP), tax code 02270060813, or by certified email to fondazioneericearte@pec.it.
The office holding the requested documents processes the application in accordance with Article 5(5) and (6) of Legislative Decree no. 33/2013. Any affected third party is sent a copy and may lodge a reasoned objection within ten days. The decision period is suspended during that time and may therefore extend to 40 days. If the request is accepted despite an objection, the documents will not be released earlier than 15 days after the affected third party has been notified.
If no decision is issued within 30 days—or the longer period that applies after suspension—or if access is refused in whole or in part, the applicant may request a review by the Supervisory Body, represented by Davide Candia at odv@fondazioneericearte.org. A reasoned decision on the review must be issued within 20 days. Protection of the right of civic access is governed by Legislative Decree no. 104 of 2 July 2010.
